The petitioner apprehends his arrest in connection with Ahiyapur P.S. Case No. 979/2018 registered for the offence punishable under Sections 25(1-B)A/26/35 of the Arms Act. Learned counsel for the petitioner submits that the alleged recoveries were not made from the conscious possession and the seizure-list has been made in presence of the co-accused which has no evidentiary value. The petitioner is not having any criminal antecedent.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court

Patna High Court CR. MISC. No.33217 of 2019(2) dt.20-05-2019 2/2 below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur, in connection with Ahiyapur P.S. Case No. 979/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
