2. The petitioner seeks bail in connection with Bankankhi P.S. Case No. 429/2024 registered for the offence punishable under Sections 309(4) of the Indian Penal Code.
3. The case of prosecution in brief is that on 22/11/24 while the informant who is a Customer Relation Officer in Samasta Microfinance was coming back to Banmankhi after collecting Rs. 23,780/-, meanwhile three accused persons riding on a motorcycle near Hriday Nagar Chowk at around 18:45 hrs arrived and looted Rs. 23,780/-, an OPPO mobile phone and motorcycle from the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

He further submits that the petitioner is not named in the F.I.R., his name transpired during the course of investigation on the basis of self confession of the petitioner which has no evidentiary value. He is in custody since 15.01.2025.
5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail. He submits that looted Oppo mobile bearing IMEI No. 862888056873198, 862888056873180 was recovered from the possession of the petitioner and also on the basis of his confession looted motorcycle was recovered from the possession of co-accused Anil Kumar Pandit. The said confessional statement was recorded in Banmankhi P.S. Case No. 432 of 2024. Petitioner has two criminal antecedent.
6. Considering the aforesaid, I am not inclined to grant bail at this stage. It is accordingly dismissed.
7. Learned trial Court is directed to concluded the trial within nine months from today.
