The petitioner apprehends his arrest in Siswan P.S. case No. 274 of 2018 registered under Section 147, 341, 323, 324, 379, 307 of the IPC.

The informant named the petitioner along with nine other accused persons and alleged that when he went on his field, Syed Sadique Abbas @ Raju assaulted him with knife on his head and he fell down on the ground. Syed Nazre Imam, the petitioner, is alleged to have pressed the neck of informant and snatched the chain made of gold. Other accused persons also assaulted the informant.

The learned counsel for the petitioner submits that there is counter version being Siswan P.S. case No. 273 of 2018. The informant got one injury, cut wound lacerated on right side

Patna High Court CR. MISC. No.28817 of 2019(2) dt.01-05-2019 2/2 of skull skin deep. The injury is opined to be simple in nature. There is no injury on the neck of informant. The petitioner is alleged to have pressed the neck of informant. The injury on head is attributed to Syed Sadique Abbas @ Raju. Taking into consideration the facts that there appears to be land dispute and petitioner is alleged to have pressed the neck of the informant but no corresponding injury is found, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Siwan in connection with Siswan P.S. case No.274 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
