Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 366, 504, 506/34, 366 (A) and 376 of the Indian Penal Code and 4/6 of POCSO Act. According to prosecution case, the informant alleged that the accused petitioner kidnapped her twenty years old married daughter for marrying with her.
Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has falsely been implicated in this case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated against the petitioner and he has falsely been implicated in the case due to some ulterior motive. Learned APP for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits
Patna High Court CR. MISC. No.29895 of 2022(5) dt.16-03-2023 2/2 that it appears from the medical report of the victim that after kidnapping the victim girl by the petitioner, she became pregnant. Further submits that the meedical report also reveals that the petitioner has committed wrong with the victim. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Amnaur P.S. Case No. 38/2022 pending in the court of learned Additional Sessions Judge (POCSO Act), Saran at Chapra Prayer is refused.
