The present application has been filed for modification of order dated 15.09.2017 passed in Cr. Misc. No. 42244 of 2017 by which the petitioner was granted anticipatory bail in connection with Trial No. 2657/2016, arising out of Complaint Case No. 3500/2014, pending in the court of learned C.J.M. Saran at Chapra. The petitioner was to surrender in the court below within a period of six weeks from the date of order dated 15.09.2017 and furnish bail bond.

Learned counsel for the petitioner submits that due to some unavoidable reason, the petitioner could not surrender in the

Patna High Court Cr.Misc. No.61675 of 2017 (2) dt.03-01-2018 2/2 court below in time and furnish bail bond.

Learned counsel for the petitioner prays for further four weeks' time so that the petitioner could surrender in the court below and furnish bail bond.

Considering the aforesaid facts and circumstances, four weeks' further time is granted to the petitioner to surrender and furnish bail bond in the court below.

The order dated 15.09.2017 passed in Cr. Misc. No. 42244 of 2017 is modified to the extent as indicated above. The modification application is allowed.
