Petitioner apprehends his arrest in Raghunathpur P.S. Case No.204 of 2018, registered under Sections 30(c), (d), 36, 38 and 41(1) of the Bihar Prohibition and Excise Act, 2016. The informant, ASI of Raghunathpur P.S., said to have got secret inputs about keeping of liquor in the field of Vishwanath Singh by the petitioner and four others and when the police went to raid the place, the petitioner and others are said to have fled away but 1900 litres of Indian made foreign liquor kept in 220 cartons was recovered.

Learned counsel for the petitioner submits that there is nothing on record to show that the petitioner had kept the liquor in the field of Vishwanath Singh. The informant did not disclose the source nor anybody has come to say that it was petitioner

Considering the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Special Judge Excise, Siwan in connection with Raghunathpur P.S. Case No.204 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
