The petitioner seeks bail in connection with Hisua P.S. Case No.303/2022, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

Allegation against the petitioner is that he along with other co-accused persons have killed the son of the informant. 4.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He is not named in the F.I.R. and has been falsely implicated in this case due to ulterior motive. His name transpired in this case on the basis of confessional statement of one Priti Kumari. There is general and omnibus allegation
Patna High Court CR. MISC. No.36749 of 2024(3) dt.12-07-2024 2/2 against the petitioner. There is no eye witness to the alleged occurrence. The petitioner has no criminal antecedent and has been languishing in custody since 07.02.2024. 5.
Learned APP for the State opposed the prayer for bail by submitting that there is ample evidence against the petitioner in the case and diary and there is specific allegation that the petitioner is the main assailant.

Considering the facts and circumstances of this case and the nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for grant of bail on his behalf is rejected. 7.
This application is accordingly dismissed.
