JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 Earlier the prayer for bail of the petitioner was dismissed vide order dated 29.10.2018 passed in Cr. Misc. No. 46109 of 2018 and the case is under sections 365, 364, 302, 201 and 120B of the Indian Penal Code Submission of learned counsel for the petitioner is that he has been made accused only on the basis of information supplied by the spy and except that there is nothing against the petitioner to connect him with the occurrence. Further he has been in judicial custody since 14.12.2017 and other accused persons have been granted bail by this court as well as by the different coordinate Benches of this Court vide order dated 20.09.2018 passed in Cr. Misc. No. 47107 of 2018, vide order dated 08.01.2019 passed in Cr. Misc. No. 78382 of 2018, vide

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magaistrate -Ist Class, West Champaran, Bettiah, in connection with Bettiah Town P.S. Case No. 866 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds (Vinod Kumar Sinha, J) sunilkumar/- U T
