JUSTICE SANJAY PRIYA ORAL ORDER 29-05-2019 Heard learned counsel for the petitioner, learned counsel for informant and the learned APP for the State. The petitioner seeks bail in Sheosagar P. S. Case No. 411 of 2018 instituted for the offence under Section(s) 147,148,149, 302 of the Indian Penal Code.

In the written report, it is alleged that on the date of occurrence this petitioner along with other accused persons as named in the written report armed with various weapons surrounded the father of informant. It is further alleged that this petitioner assaulted by means of sword and other accused persons also assaulted the father of informant with weapons in their hand, on account of which, he died. The informant is daughter of deceased.

Patna High Court CR. MISC. No.28554 of 2019(3) dt.29-05-2019 2/2 Case diary has been received, wherein, postmortem report of deceased is available. The doctor has mentioned in the postmortem report cause of death to be head injury, hemorrhage and shock caused by hard and blunt substances of very very heavy objects.

In the written report there is allegation that this petitioner assaulted the father of informant by means of sword but no injury of sword was found on the person of deceased by the doctor.

Learned counsel for informant has appeared and opposed the prayer for bail.

Petitioner is in custody since 20.12.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge- VII-cumACJM Sasaram, Rohtas in connection with Sheosagar P. S. Case No. 411 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
