The petitioner seeks regular bail in registered for the offences punishable under section 376 and other allied sections of the Indian Penal Code, section 6 of the POCSO Act and section 4 of the Dowry Prohibition Act .

As per the prosecution case, the victim was subjected to repeated sexual intercourse by the petitioner for sometime on the pretext of marriage.

Learned counsel for the petitioner submits that in fact there was love affair between the petitioner and the victim, who is major as the medical board has assessed her age to be above 20 years. Victim was very much aware of the outcome of continuing physical relation with the petitioner and consequent pregnancy. Petitioner is in custody since 1.4.2021. Considering the nature of accusation against the petitioner and the aforesaid statement of the victim, his prayer for bail is refused.
