JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-08-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Araria P.S. Case No. 280 of 2018, registered for offences punishable under Sections 341, 323, 379 and 420/34 of the Indian Penal Code.

As per F.I.R., allegation against the petitioners is for providing inferior quality of seeds of maize to the informant and when the informant demanded money, then the petitioners assaulted the informant and also snatched Rs.15,000/-. Submission of the learned counsel for the petitioners is that the petitioners are the authorized dealer of the seeds and the petitioner no.2 is the son of petitioner no.1 and they have falsely been implicated in this case and they have no criminal antecedent. Learned A.P.P. opposes the prayer for bail.

No.46683 of 2018 (2) dt.10-08-2018 2/2 Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named on surrender or arrest within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case No. 280 of 2018, G.R. No. 1434 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
