JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Rasulpur P.S. Case no. 114 of 2016, registered under Sections 341, 323, 324, 379, 307, 504 and 325/34of the Indian Penal Code. The accusation is that on 17.12.2016 at about 6.50 A.M. informant along with his maternal uncle was returning to his house from old market Rusulpur then in the way, petitioner along with his brother Binda Pandit and Tarkeshwar Pandit came armed with Dab, Pahsul, Lathi and rod and started abusing and assaulted to the informant and caused blood oozing injury at his head, when Harendra Pandit brother of the informant reached to save to the informant then he was also assaulted at his head. When Parwati Kuwar, mother of the informant, rushed to save the informant then she was also assaulted. At that time, Binda Pandit snatched golden chin cash from the pocket of

Learned counsel for the petitioner submits that petitioner and informant are Gotia and due to land dispute hot talks were exchanged. Further submission is that the injuries as found on the person of brother and mother of the informant are simple in nature except injury No.1, which is fracture of right ring finger. Further submission is that no specific overt act has been attributed against the petitioner and the petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.X, Saran at Chapra in connection with Rasulpur P.S. Case No. 114 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
