JUSTICE SATYAVRAT VERMA ORAL ORDER 11-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State through video conferencing. The petitioner seeks bail in connection with Bhairab Asthan P. S. Case No.07 of 2021, instituted for the offences under Sections 304(B), 201, 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 10.01.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the informant alleges that his daughter Kabita Kumari (deceased) was married in the Year 2018 with Prakash Sadai and for nonfulfilment of dowry demand, the deceased was being tortured

Patna High Court CR. MISC. No.39973 of 2021(2) dt.11-01-2022 2/3 and for which, she informed her sister on 07.01.2021 and thereafter, she was killed and her body was cremated in absence of her parents and family members.

The learned counsel for the petitioner submits that petitioner is the brother-in-law of the deceased and is separate in mess and is a student of B.A. Part-I and his entire career would be jeopardized in the event if petitioner is not granted bail. The learned counsel for the petitioner further submits that the husband of the deceased is seeking anticipatory bail and has filed Cr. Misc. No.39124 of 2021, which is pending before this Court.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 10.01.2021, he is a person with clean antecedent, chargesheet has been submitted in the case and is brother-in-law of the deceased and that the husband is seeking his remedies available in law, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Jhanjharpur, Madhubani in connection with Bhairab Asthan P. S. Case No.07
