The petitioner apprehends his arrest in Forbesganj (Simraha) P.S. Case No.85 of 2021 registered under Section 304(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that the petitioner has not been specifically alleged for subjecting the deceased (wife). The deceased died due to catching of fire. The petitioner has got no criminal antecedent. Learned A.P.P. for the State has opposed the prayer for anticipatory bail by contending that the petitioner is the husband of the deceased. There is specific allegation against the petitioner that he continuously used to torture and harass the

Patna High Court CR. MISC. No.40011 of 2021(2) dt.02-03-2022 2/2 deceased (wife) for non-fulfillment of demand of motorcycle. The mother-in-law of the deceased in collusion with the petitioner put the deceased on fire. Therefore, the petitioner does not deserve anticipatory bail.

Having considered the facts aforesaid, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his prayer for bail is rejected. Harish/- (Arvind Srivastava, J) U T
