JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-01-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Warsaliganj P.S. Case no. 297 of 2017, registered under Sections 448, 149, 341, 323, 379, 436 and 427/34 of the Indian Penal Code. The accusation is that petitioners along with five unknown came at the house of the informant Mini Devi and at the instance of the petitioner No.3 Bilash Ram, all the petitioners and other entered in the house and started to commit loot of household articles and also burnt the house. At that time, silver and golden ornaments have also been snatched to the neck of the informant. Learned counsel for the petitioners submits that the petitioners and informant are co-villagers and due to lodging of Warsalilganj P.S. Case No. 291 of 2017 on 22.10.2017 by Moni Devi,

Patna High Court Cr.Misc. No.1196 of 2018 (2) dt.11-01-2018 2/2 wife of petitioner No.2 against the husband of the informant and her other family members, this false case has been lodged. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Warsaliganj P.S. Case No. 297 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
