2. The petitioner apprehends his arrest in connection with Dagarua P.S. Case No. 32/2020 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act and Sections 272/273 of the Indian Penal Code.

3. The petitioner is not caught on the spot though the recovery is of 519 litres 120 ml of foreign liquor.

4. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

5. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks

Patna High Court CR. MISC. No.35285 of 2024(2) dt.21-06-2024 2/2 from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (Excise 01), Purnea/ concerned court in connection with Dagarua P.S. Case No. 32/2020, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
