JUSTICE SATYAVRAT VERMA ORAL ORDER 11-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State through video conferencing. The petitioner seeks bail in connection with Tisiauta P. S. Case No.22 of 2021, instituted for the offences under Sections 302/ 120B of the Indian Penal Code and Section 27 of the Arms Act.
The learned counsel for the petitioner submits that the petitioner is in custody since 24.02.2021, he is a person with clean antecedent, charge-sheet has been submitted in the case and is a lady.
The learned counsel for the petitioner submits that the informant alleges that his nephew was shot by unknown criminals and the informant based on suspicion alleged that deceased was having affair with this petitioner and she was

Further, it is alleged that petitioner was in touch with other boys also, who used to threaten the deceased not to come in their way. Hence, it is alleged that the petitioner in connivance with the accused persons got the deceased killed.
The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that informant accepts that this petitioner and the deceased were in love and there were boys, who were threatening the deceased not to come in their way and as such, it may a possibility that those who detested the deceased on account of relationship with the petitioner might have killed him and the petitioner based on suspicion came to be implicated in the present case. The learned counsel submits that since the petitioner was selected as a Constable, as such, she was falsely implicated in the present case.
The learned A.P.P. for the State opposes the bail application.
Considering the fact that the petitioner is in custody since 24.02.2021, he is a person with clean antecedent, chargesheet has been submitted in the case and is a lady, the petitioner, above-named, is directed to be released on bail on his furnishing
Patna High Court CR. MISC. No.39990 of 2021(3) dt.11-01-2022 3/3 bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of Miss Priti Roy, J. M. 1st Class, Vaishali at Hajipur in connection with Tisiauta P. S. Case No.22 of 2021.
The application stands allowed.
