JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-09-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 167 of 2018, disclosing offence under Section 498A of the Indian Penal Code. Case is under Section 498-A of the IPC.

On appearance of the opposite party no. 2, the matter was referred to the Patna High Court Mediation & Reconciliation Center, vide order dated 18.07.2019. The report of Mediator is available on record at Flag "M" which disclosed that the dispute between the parties has been resolved and the terms of settlement mutually agreed upon them, which is attached with the mediator's report. The Mediator's report disclosed that one time final settlement of payment of Rs.65,000/- to the opposite party no.2, which will be paid in

Patna High Court CR. MISC. No.29646 of 2019(5) dt.04-09-2019 2/3 three equal installments within a period of three months and thereafter, they are at liberty to live their own life. The memorandum of agreement is signed by both the parties as well as their respective counsel.

Learned counsel for the petitioner and learned counsel for the opposite party no.2 have admitted the above facts. Having heard both sides, considering the above facts and circumstances, as stated above, the provisional bail granted to the petitioner vide order dated 09.05.2019 is extended till 27.11.2019 and on that day, both the parties shall appear before the learned court below and once being satisfied that the total amount has been paid to the opposite party no.2, the learned court below will confirm the bail bonds of the petitioner, otherwise he is free to pass any order or orders which may be deemed fit and proper including the cancellation of the bail bonds of the petitioner.

Let a copy of Mediator's report along with terms of agreement be sent to the court concerned for needful. With the aforesaid observations, this application is disposed of.
