The petitioner seeks Anticipatory bail in connection with Complaint Case No. 897 of 2017 registered under Section 406 of the Indian Penal Code.
Petitioner is the Branch Manager of State Bank of India. Allegation against him is that he refused to return the Title document which were deposited as security for loan to the complainant and when the complainant asked for those documents the petitioner pushed him away from the office. It has been submitted on behalf of the petitioner that the Title documents was deposited in the name of two persons,
Patna High Court Cr.Misc. No.48103 of 2018(2) dt.17-09-2018 2/2 namely Amar Nath Prasad (complainant) and Ram Nath Prasad but the complainant wants to take back the documents of Ram Nath Prasad also which the petitioner refused to deliver him. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. (East), Muzaffarpur, in connection with Complaint Case No. 897 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
