The petitioner seeks bail in a case registered under Sections 147, 148, 149, 323, 307, 302 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in brief is that while the informant and her husband were working in field, the accused persons variously armed came there and started abusing and in consequence thereof, the husband of the informant was badly assaulted. It is also alleged that while the informant came to rescue him, she was fired by accused persons. The husband of the informant died in course of treatment.

It has been submitted on behalf of the petitioner that the

Patna High Court CR. MISC. No.28948 of 2019(6) dt.17-08-2019 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 19-02-2019. Charge sheet has already been submitted. General and omnibus allegation has been made against six persons. Neither specific injury is attributed nor any specific overt act is alleged against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Bachhwara P.S. Case No. 91 of 2018.
