The petitioner has preferred this application for grant of regular bail in a case registered under section 394 of the Indian Penal Code.

As per the prosecution case, while the informant was changing his punctured tyre of his vehicle, it is stated that the four accused persons with their faces covered came and assaulted the informant as also his driver and took away Rs. 10,000/- in cash besides other articles as mentioned in the FIR. It is submitted by learned counsel for the petitioner that the FIR was registered against four unknown. The name of the petitioner transpired in course of investigation in the confessional statement of co-accused Pramod Kumar made

Patna High Court CR. MISC. No.40283 of 2021(3) dt.18-02-2022 2/2 before police which is inadmissible. The said Pramod Kumar has been enlarged on bail vide order dated 25.10.2021 passed in Cr. Misc. no. 41714 of 2021. Inspite of being in custody since 25.3.2021 the petitioner has not been put on T.I Parade and charge sheet has been submitted in the case. No incriminating article has been recovered from the petitioner's possession who has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner and grant of bail to the above co-accused Pramod Kumar on whose statement the name of the petitioner transpired, the Court directs the petitioner to be enlarged on bail in connection with Obra P.S. Case no. 64 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Daudnagar, Aurangabad, Bihar.
