The petitioner apprehends his arrest in Khagaul P.S. Case No.179 of 2020, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code. The petitioner and two other co-accused persons are said to have killed the son of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that only on suspicion, the petitioner has been made accused in the present case. It is further submitted that there is no eye witness of the occurrence. The petitioner has got no criminal antecedent as stated in para-3 of the bail application.

Patna High Court CR. MISC. No.40240 of 2021(3) dt.04-07-2022 2/2 The learned APP for the State opposed the prayer for anticipatory bail of the petitioner and submitted that there is ample evidence against this petitioner in the case diary showing his involvement in the alleged offence.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
