ANJANA MISHRA ORAL ORDER 31-01-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Ganga Bridge P.S. Case No.83 of 2015 for allegedly having committed the offence under Sections 304B, 201 of the Indian Penal Code and Section 3/4 of the D.P. Act. Learned counsel for the petitioner submits that in view of the changed circumstances that the husband of the victim lady has surrendered and also because similarly situated co-accused, namely, Shakuntala Devi and Anjeet Rai, have been extended the privilege of anticipatory bail by this Court in Cr.Misc. No.31424 of 2017, vide order dated 29.11.2017 (Annexure 4), the petitioner may also be extended the same
Patna High Court Cr.Misc. No.4113 of 2018 (2) dt.31-01-2018 2/2 benefit.
Considering the entire facts and circumstances and also the aforesaid order dated 29.11.2017 (Annexure 4) appended to the present application, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Ganga Bridge P.S. Case No.83 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
