JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-04-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Isakchak P.S. Case No. 54 of 2009 (G.R. No.3045 of 2009) (S.T.No.188A of 2010) for the offenses under Sections 341, 323, 307, 379, 504, 34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner would submit that earlier petitioner was granted bail, but on account of lack of attendance, the bail bond of the petitioner was cancelled and thereafter, he was arrested. The petitioner is in custody since 06.07.2018.
Considering the fact that earlier petitioner was granted bail on merits, the Court is inclined to grant bail to the
Patna High Court CR. MISC. No.28070 of 2019(2) dt.29-04-2019 2/2 petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the 9th Additional District Judge, Bhagalpur, in connection with Isakchak P.S. Case No. 54 of 2009 (G.R. No.3045 of 2009) (S.T.No.188A of 2010) subject to the condition that petitioner shall appear on each and every date fixed by the court below and if on two consecutive dates he fails to appears without any cogent reason, the court below shall be at liberty to cancel his bail bonds.
