JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2018 At the very outset, learned counsel for the petitioners seeks permission to withdraw this application with respect to petitioner No.1 Rohit Kumar, as he has been arrested during pendency of this application.

In view of above submission, this application is dismissed as infructuous with respect to petitioner No.1 Rohit Kumar.

Heard learned counsel for the petitioner No.2. Petitioner No.2 apprehends his arrest in connection with Paras Bigha P.S.Case No. 65 of 2018 registered for the offences punishable under Sections 147, 149, 341, 323, 325, 307 and 504 of the Indian Penal Code.

Allegation against petitioner No.2 and other accused persons is of assault to the informant and occurrence took place

Patna High Court Cr.Misc. No.48164 of 2018 (2) dt.23-08-2018 2/2 due to pay of song in DJ.

Submission of learned counsel for the petitioner is that only one injury was found on the person of informant and, that too, is simple in nature.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner No.2, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Bharti, Judicial Magistrate, 1st Class, Jehanabad, in connection with Paras Bigha P.S.Case No. 65 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
