The appellant apprehends his arrest in Marhaurah P.S. Case No. 54 of 2023 registered for the offences punishable under Sections 341, 323, 504 of the Indian Penal Code and Section 3(1)(r)(s)/3(2)(va) of the SC/ST (POA), pending in the Court of learned Additional Sessions Judge 3rd Saran at Chapra. After some arguments, learned counsel for the appellant seeks permission to withdraw this application. Permission is granted.

Accordingly, the instant application is dismissed as withdrawn. However, if the appellant surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. APP (SJ) No.2231 of 2023(3) dt.28-06-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order, considering the fact that the appellant has no criminal antecedent.
