JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 This application, for grant of anticipatory bail, arises out of Sangrampur P.S. Case No. 134 of 2018, disclosing offences under Sections 363, 366(A), 504 and 506 of the Indian Penal Code.

Allegation as per F.I.R. is that minor daughter of the informant was traceless and he suspects the hands of co-accued Mithilesh Giri and he went to the house of said co-accused Mithilesh Giri, where, this petitioner abused and threatened the informant.

Submission of learned counsel for the petitioner is that he has no hand in kidnapping the minor daughter of the informant rather only suspicion has been raised and the girl in

Patna High Court CR. MISC. No.29419 of 2019(3) dt.17-07-2019 2/2 her statement under Section 164 Cr.P.C. has also not named the petitioner rather, she made allegation against co-accused Mithilesh Giri, who has already been enlarged on bail by a coordinate Bench of this Court vide order dated 25.02.2019 passed in Cr. Misc. No. 78701 of 2018.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Sangrampur P.S. Case No. 134 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
