ANJANA MISHRA ORAL ORDER 07-11-2017 Heard learned counsel for the petitioner and learned Advocate General appearing on behalf of the State. On the last occasion, this Court noticed the fact that there had been improper compliance of the order and had directed that the Principal Secretary, Building Construction Department, Government of Bihar, the Superintending Engineer, P.W.D. Building Circle, Gaya and the Chief Engineer, Dakshni Upbhag, Building Construction Department, Government of Bihar be personally present to justify their inaction in passing order in

Patna High Court MJC No.3026 of 2013 (16) dt.07-11-2017 2/2 favour of the petitioner despite specific direction of this Court. It appears that now the orders have been issued in favour of the petitioner and the Accountant General, Bihar has also been apprised of the situation and papers have been forwarded to him for issuance of order of pension and gratuity. It thus appears that no further cause exists and the present MJC application can be disposed of on the basis of the averments made in paragraph Nos. 6, 7, 8, 9 and 10 of the showcause filed by opposite party No. 2. The contempt application thus, stands disposed of and it would be in the interest of justice that the Accountant General, Bihar shall expedite the payments of the petitioner as early as possible, preferably within three months.

This application is thus, disposed of.
