====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 20-06-2025 Heard learned counsel for the petitioner and Mr. Rabindra Kumar, learned A.P.P. for the State.

2. Learned counsel for the petitioner submits that petitioner was granted the privilege of anticipatory bail by an order dated 19.04.2025 in Cr. Misc. No. 83633 of 2024 with a condition that one of the bailors of the petitioner shall be his father, namely, Bhaiya Ram Ray. It is further submitted that father of the petitioner had died much prior to filing of the anticipatory bail application but inadvertently in Cr. Misc. No. 83633 of 2024 the word 'Late' was not prefixed before the name of the father of the petitioner, as such, it is submitted that the instant modification application has been filed seeking modification of the order dated 19.04.2025 in Cr. Misc. No. 83633 of 2024 insofar as the condition of grant of anticipatory

Patna High Court CR. MISC. No.30630 of 2025(3) dt.20-06-2025 2/2 bail has been recorded.

3. Learned counsel for the petitioner next submits that a supplementary affidavit has been filed wherein death certificate of the father of the petitioner has been brought on record and from perusal of the same, it would manifest that the father of the petitioner died on 23.03.2019.

4. In view of the submissions made by the learned counsel appearing on behalf of the petitioner, order dated 19.04.2025 in Cr. Misc. No. 83633 of 2024 is modified to read as, in the event, if the petitioner surrenders on or before 02.07.2025, he shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each and one of the bailors of the petitioner shall be his brother, namely, Chandan Kumar.

5. Accordingly, the modification application is allowed.
