JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-09-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.

Prayer for bail of this petitioner was lastly rejected by this court vide order dated 23.11.2020 passed in Cr. Misc. No. 21990/2020. By order dated 11.08.2021 a report was called for from the court below about the stage of trial which discloses that the case is pending for recording of statement of the accused persons u/s 313 of the Cr. P. C.

Considering the nature of allegation made against this petitioner in the FIR and progress of the trial, I am not inclined

Patna High Court CR. MISC. No.40211 of 2021(3) dt.29-09-2021 2/2 to enlarge the petitioner on bail. Accordingly, the same is rejected.

However, since the petitioner is in custody since 10.10.2015, the trial court is directed to conclude the proceedings as early as possible.
