JUSTICE AMARESH KUMAR LAL ORAL ORDER 02-02-2015 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for offences punishable under sections 498(A), 304(B)/34 of the Indian Penal Code.
The allegation against the petitioners is to have caused the death of the deceased due to non fulfillment of the demand of dowry.
It is submitted that the petitioners are Nandosi and Nanad (brother -in-law and sister-in-law) of the deceased respectively, and as such there was no occasion to go to the place of the alleged occurrence and they have no criminal antecedent and the husband of the deceased is in custody. Considering the facts and circumstances, in case of arrest
Patna High Court Cr.Misc. No.32571 of 2014 (2) dt.02-02-2015 2/2 or surrender within a period of four weeks, the above named petitioners shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Shri Subir Kumar, Judicial Magistrate 1st class, Madhubani in connection with Khirhar P. S. Case No. 15 of 2014 corresponding to G.R. No. 486 of 2014, subject to condition as laid down under Section 438( 2) of Cr. P.C.
