JUSTICE JYOTI SARAN ORAL ORDER 03-02-2016 This application has been filed complaining of non compliance of the order dated 19.8.2014 passed by this Court in C.W.J.C.No.747 of 2013 whereby the petitioner was given liberty to take recourse of appellate remedy available to her under the Bihar Public Land Encroachment Act, 1956 and which was to be disposed of expeditiously and preferably within 3 months of its filing.
On the very first day this matter was taken up on 27.1.2016 that a show cause was filed enclosing an order dated 3.8.2015 of the Collector, Munger disposing of the Appeal Case No. 8 of 2014-15 filed by the petitioner. On request made by Mr. Sanjay Kumar Verma appearing for the petitioner that the matter was
Patna High Court MJC No.2755 of 2015 (3) dt.03-02-2016 2/2 adjourned and is taken up today when Mr. Verma while accepting that the appeal has been disposed of complains against the manner of disposal as well as the time taken.
Be that as it may, that the order passed in the writ petition stands complied, no case for contempt is made out. The merits/demerits of the order cannot be a subject matter of contempt and the petitioner if so advised, may question the same in an appropriate proceedings to be filed before an appropriate forum.
