JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-08-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Jhajha P.S.Case No. 328 of 2017, registered for offences punishable under Sections 147, 149, 341, 323, 354, 307 and 504 of the Indian Penal Code.
As per F.I.R., allegation against the petitioner is that the petitioner along with other co-accused assaulted with farsa and rod blow over the informant, causing injury. Submission of the learned counsel for the petitioner that the petitioner has not committed any offence and he has falsely been implicated in this case and injuries found on the person of the informant are simple in nature except injury No. 1. No.46456 of 2018 (2) dt.10-08-2018 2/2 informant, oppose the prayer for bail stating that the injuries are grievous in nature and the allegation with rod on the person of the informant is serious as appears from Annexure-4 series. n In view of allegation against the petitioner, above named, I am not inclined to grant bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrenders before the Court below and makes prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court. with the aforesaid observation, this application is dismissed (Vinod Kumar Sinha, J) Sudha/-sunil U T
