The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 302, 504,

Patna High Court CR. MISC. No.30089 of 2022(3) dt.29-11-2022 2/3 506 of the Indian Penal Code.

It is a case of commission of murder of the brother of the informant.

It is submitted by learned senior counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. The allegation against petitioner Nos. 1,2, and 3 is general and omnibus whereas petitioner Nos. 4 and 5 are not named in the F.I.R. Though petitioner No. 2 is alleged to have fired from his pistol in the air but it did not hit anyone. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st, Class,
