====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-05-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 310(4), 310(5), 3(5) of the Bharatiya Nyaya Sanhita, Section 25(1-B)a, 26, 35 of Arms Act and Section 30(a)/37 of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 4 litres illicit liquor and arms and ammunition were recovered from poultry farm of coaccused Randhir Yadav.

4. Learned counsel for the petitioners submits that no incriminating material has been recovered from conscious

Petitioners have been made accused on the basis of confessional statement of co-accused Kumar Gautam who was apprehended on the spot. Petitioner No. 1 has got five criminal antecedents and petitioner No. 2 has got no criminal antecedent of similar nature.

5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioner No. 1 has got five criminal antecedents, some of which are of similar nature.

6. Considering criminal antecedents of similar nature, prayer for anticipatory bail of petitioner No. 1 is refused.

7. However, in view of the fact that no incriminating material has been recovered from possession of petitioner No. 2 and he has got no criminal antecedent of similar nature, this anticipatory bail is allowed with regard to petitioner No. 2 and it is ordered that let the above named petitioner No. 2 in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Special Judge, Excise, Patna City in connection with Khusrupur P. S. Case No. 90 of 2025, subject to condition as laid down under
