2. The petitioner apprehends her arrest for the offences alleged under Sections 406, 409, 420/34 IPC registered in connection with Arer P.S. Case No. 91/2016, G.R. No. 829/2016.

3. It is submitted that the petitioner has been falsely implicated merely because she happens to be the Secretary of the Shiksha Samiti, Middle School, Dhakjari. The petitioner is not named in the F.I.R. It is stated that initially the amount for development work of the School has been withdrawn by the joint signature of the Headmaster and the petitioner, being the Secretary of the Shiksha Samiti of the School in question. The petitioner is only one of the signatories of the cheques for withdrawal of the amounts meant for development/construction work of the school building. Since the development/construction work of the school has not been completed by the incharge Headmaster, the petitioner stopped signature on cheques and thereafter, the amounts were withdrawn by joint signature of the incharge Headmaster and one Shri Raghvendra Jha, Assistant Teacher of the School. Other coaccused Anita Devi, who was Secretary of Shiksha Samiti of another school has been granted anticipatory bail by this Court in Cr. Misc. No.

Patna High Court CR. MISC. No.28309 of 2019(2) dt.01-05-2019 2/2 18775 of 2019. The petitioner claims clean antecedents.

Be that as it may, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Sri P. Kishore, learned J.M. Ist Class, Benipatti, District Madhubani in connection with Arer P.S. Case No. 91/2016, G.R. No. 829/2016, subject to the conditions as laid down under Section 438 (2) Cr.P.C. and also subject to the following further conditions:

i. That one of the bailors shall be a close relative of the petitioner. ii. That the petitioner shall not indulge in any similar offence till conclusion of the trial.

iii. That the petitioner shall co-operate with the investigation, if not already concluded, and make herself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.

iv. The petitioner shall be well represented in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, her bail bond shall be liable to be cancelled by the learned Court concerned.
