Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 363 and 366A of the Indian Penal Code.

As per the prosecution case, the victim girl was kidnapped by the co-accused Ranjan Paswan in connivance with the petitioner Ram Kewal Paswan for marriage. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession

Learned counsel has further submitted that the victim is a major girl and her date of birth as per her Aadhar card is 01.01.2001. It has further been submitted that there was love affair between the victim and the co-accused. The victim in her statement under section 164 of the C.r.P.C. has stated that she married the co-accused on her own will and she gave birth to two children. The other co-accused person has already been granted anticipatory bail by the Co-ordinate bench vide order dated 12.05.2022 passed in Cr. Misc. No. 3434 of 2022. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 08.04.2022. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sitamarhi in connection with Sonbersa P.S. Case No. 85 of 2018.

The application stands allowed.
