2. The petitioners seek bail in connection with Shikarpur P.S. Case No. 130 of 2026, instituted for the offences
Patna High Court CR. MISC. No.30591 of 2026(3) dt.21-07-2026 2/3 punishable under Sections 103(1), 126(2), 127(2), 109(1), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in short, is that the petitioners and other accused persons allegedly formed an unlawful assembly, assaulted and humiliated the informant's minor daughter and her companion, and thereafter strangulated the girl to death.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioners. Learned counsel for the petitioners also submits that there is no any eye witness of the alleged occurrence. It is next submitted that the daughter of the informant has committed suicide. There is no specific allegation levelled against the petitioners rather the same is general and omnibus in nature. Petitioner in Cr. Misc. No. 30591 of 2026 is in custody since 06.02.2026 and petitioner in Cr. Misc. No. 29880 of 2026 is in custody since08.02.2026 and both of them have got no criminal antecedent. Learned counsel for the petitioners further submits that other co-accused has been granted regular bail by a Co-ordinate Bench of this Court vide
Patna High Court CR. MISC. No.30591 of 2026(3) dt.21-07-2026 3/3 order dated 01.07.2026 passed in Cr. Misc. No. 31965 of 2026.
5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioners.
6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners.
7. Let the petitioners be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Shikarpur P.S. Case No. 130 of 2026, (Rudra Prakash Mishra, J) Rajorshi/- U T
