The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 354, 385, 379, 504 and 506 of the Indian Penal Code & Section 27 of the Arms Act.
Learned counsel for the petitioners submits that the petitioners are woman having clean antecedent and they have been falsely implicated in the present case, it is next submitted that the
Patna High Court CR. MISC. No.29555 of 2022(2) dt.16-11-2022 2/2 date of occurrence is 25.12.2021 and the complaint came to be filed on 18.01.2022 i.e. after a delay of 24 days without any plausible explanation that in itself creates doubt with regard to the veracity of the allegations as alleged, it is next submitted that even the injuries are simple.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Gurua P.S. Case No. 44 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
