JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 03-09-2021 Heard learned counsel for the petitioner and the learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 457 and 380 of the Indian Penal Code.

The prosecution case in brief is that the informant and his family had gone to his house situated in village Virsagar, District Madhubani. When the informant returned, he found that ornaments made of gold and silver, laptop, mobile and cash were stolen.

By order dated 23.06.2021, report was called for regarding stage of trial and the time likely to be taken in conclusion of the trial, which has come and kept at Flag- 'R'.

Patna High Court CR. MISC. No.7746 of 2021(3) dt.03-09-2021 2/2 The Additional Chief Judicial Magistrate-I, Birpur has reported that the charge has been framed and notices have been issued to the witnesses, but due to Covid-19 pandemic, the witnesses are not appearing in court. It is reported that six months' time is required for conclusion of the trial.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Birpur P.S. Case No.246 of 2019.

However, the learned court below is directed to conclude the trial within six months from the date of receipt/production of a copy of this order.

At the same time, the Superintendent of Police, Supaul is directed to ensure the production of the witnesses in the learned court below so that the trial must be concluded within a period of six months.
