This application for anticipatory bail arises out of Danapur P.S. Case N0. 291 of 2016, disclosing offences under Section 366A of the Indian Penal Code.

A supplementary affidavit has been filed on behalf of the petitioners, which is taken on record.

Statement of the victim recorded under Section 164 of the Code of Criminal Procedure has been brought on record by way of Annexure-5 to the said supplementary affidavit. The alleged victim in her statement has disclosed that she had left the place out of her own volition with the accused Anil Sahni to marry and they are already married.

Patna High Court CR. MISC. No.28369 of 2019(2) dt.30-04-2019 2/2 Learned counsel for the petitioners has submitted that the allegation made in the First Information Report of kidnapping stands falsified.

This application is allowed.

Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Danapur, Patna in Danapur P.S. Case No. 291 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
