2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 118(1), 109, 103, 352, 351(2) and 61(2) of the B.N.S.
3. The case of the prosecution, in short, is that the petitioner along with others has killed one Roushan Kumar by stabbing with knife.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Leaned counsel for the petitioner has submitted that from perusal of the F.I.R., it is clear that one Vishal Kumar has also received stab wound. It has further been submitted that nature of allegation is
Patna High Court CR. MISC. No.29300 of 2026(2) dt.11-05-2026 2/2 general and omnibus. It has further been submitted that during course of investigation, Vishal Kumar has given his statement before the police and according to the statement of Vishal Kumar, the assault was specifically made by co-accused Md. Meraj and Akash Kumar. It has further been submitted that similarly situated co-accused persons Vivek Kumar Jha and Prince Kumar have already been granted bail by learned co-ordinate Bench of this Court vide Cr. Misc. No. 24681 of 2025. The case of this petitioner stands on similar footing. He is having no criminal antecedent and he is languishing in judicial custody since 08.12.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-IX, Vaishali at Hajipur in connection with Goraul P.S. Case No. 425 of 2024.
