The petitioner apprehends his arrest in Runnisaidpur P.S. Case No. 218 of 2020, registered for the offences punishable under Section 304(B)/34 of the Indian Penal Code. Prosecution case in brief is that niece of the informant was done to death by the accused persons including this petitioner due to non-fulfillment of demand of dowry. Petitioner is husband of the deceased.
It is submitted on behalf of petitioner that there is general and omnibus allegation against him. From the postmortem report, it appears that there is no external injury on the person of deceased. In fact, the deceased has committed suicide and at the time of occurrence, petitioner was living at
Patna High Court CR. MISC. No.29851 of 2020(3) dt.29-01-2021 2/2 Delhi. Petitioner has got no criminal antecedent. However, counsel for the State vehemently opposed the bail application and submitted that petitioner is husband of the deceased and there is direct allegation against him that it was the petitioner who used to torture her physically and mentally due to non-fulfillment of demand of dowry and finally killed her along with other accused persons.
Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
