The petitioner seeks pre-arrest bail in connection with Karakat P.S.Case No. 221 of 2013 registered under Sections 406, 409, 420 and 120-B of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the petitioner has been implicated in this case only because he is son of Incharge, Purchase Centre Birendra Kumar. He submitted that the petitioner is a mechanical engineer and at the time of occurrence, he was a student of Rajiv Gandhi Pradyogiki Vishwavidyalaya, Bhopal and was not in any manner connected with the affair of the Purchase Centre of which his father was the Incharge.

On the other hand, learned counsel for the opposite

Patna High Court Cr.Misc. No.833 of 2018 (2) dt.15-01-2018 2/2 party no.2 submitted that the petitioner is one of the conspirators and he conspired together with his father causing huge financial loss to the Bihar State Food and Civil Supplies Corporation Limited.

Be that as it may, regard being had to the fact that the petitioner has been implicated in this case only because he happens to be the son of Birendra Kumar, co-accused, who was Incharge of the Purchase Centre, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Karakat P.S.Case No. 221 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
