====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 13-11-2020 Due to COVID-19 Pandemic, the matter is being taken up by way of virtual Court proceeding.

The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks after restoration of normalcy. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case for the offence registered under Sections 363, 370(A)(2), 366, 364, 34 of the Indian Penal Code.

Prosecution case in short is that the petitioner and her uncle fed Rasgulla to the victim Puja Kumari @ Puja Devi.

They were trying to solemnize marriage of the victim with an old man. When the victim protested, the accused persons sold her to Savitri Devi after taking Rs. 80,000/- After that Sita organized marriage of the victim with Dipak Mina. Thereafter, at the request of the victim, Dipak Mina brought to her parents.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 22-08-2019. Charge sheet/Prosecution report in this case has already been submitted. The petitioner is a lady. The victim had left her house out of love affairs. The alleged occurrence is said to have taken place three years prior to the institution of the present case. The delay in instituting the FIR has not been explained by the prosecution. For ulterior motive, the present case has been instituted against the petitioner and her husband. The petitioner has remained in custody for more than one year.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R. Considering the aforesaid facts and circumstances of

No.29890 of 2020(2) dt.13-11-2020 3/3 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Dagarwa P.S. Case No. 155 of 2019.
