The petitioners seek pre-arrest bail in connection with Baroon P.S. Case No. 189 of 2017 registered under Sections 379, 411, 420, 120B, 340 of the Indian Penal Code, Sections 3, 4, 5 of the Bihar Illegal Mining Act and Sections 75 and 80 of Mining Rules, 2017.
It is submitted by the learned counsel for the petitioners that co-accused Lakshman Singh having more or less similar allegation to that of the petitioners has already been
Patna High Court Cr.Misc. No.1054 of 2018 (2) dt.17-01-2018 granted pre-arrest bail vide order dated 22.12.2017 passed in Cr. Misc. No.62885 of 2017.He submitted that apart from the aforesaid Lakshman Singh, several other co-accused have also been granted pre-arrest bail vide different orders passed by different Benches of this Court.
Submission of the learned counsel for the petitioners has not been disputed by the learned counsel for the State. In that view of the matter, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Baroon P.S. Case No. 189 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
