Heard the parties.

The petitioner is languishing in custody for the offence punishable under Section 394 of the Indian Penal Code. The F.I.R. of the occurrence of robbery is against four unknown persons. Petitioner is in custody since 13.08.2019 after remand from some other case. Name of the petitioner surfaced in the confessional statement of co-accused . Submission is that the petitioner was never put on T.I.P. during investigation of the case nor any incriminating article was recovered from the possession of the petitioner. Considering the lack of material for further detention of the petitioner as under trial prisoner, let the petitioner, above

Patna High Court CR. MISC. No.29644 of 2020(2) dt.25-11-2020 2/2 named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Mushahari P.S. Case No. 87 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
