JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 341, 323, 506, 224, 225, 353/34 of the Indian Penal Code.

As per the prosecution case, while this petitioner was arrested and was sitting in the police jeep, in the meantime, two FIR named accused persons and 20-25 unknown persons surrounded the jeep and got him released.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is no eye witness of the occurrence. It is stated in paragraph 3 of the petition that although petitioner is accused in eight other criminal cases but in one case he has been acquitted and in other cases he is on bail. Petitioner is in custody since

Patna High Court CR. MISC. No.39612 of 2021(3) dt.17-11-2021 2/2 23.01.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the nature of accusation, gravity of the offence and criminal antecedent of the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
