JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-08-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

The present writ petition has been filed seeking the following reliefs.

Patna High Court CWJC No.12639 of 2021(2) dt.04-08-2021 2/3 "(i) For issuance of appropriate writ/order/ direction, directing the respondents to release the amount deposited alongwith interest thereon by the various Public Distribution System dealers who are the members of the pertinent no. 1 association for procuring food grains but the same had not been available with the respondent State Corporation. (ii) For direction upon the respondents to produce the copy of the relevant chart that how much amounts have been withheld by the corporation throughout the state of Bihar and detailed explanation may be asked from the respondent to demonstrate that how much amount has been paid to the different dealers."

At the outset, the learned counsel for the petitioner seeks liberty to file appropriate representation before the Principal Secretary, Food & Consumer Protection Department, Government of Bihar, Patna i.e. the respondent no. 2 for redressal of his aforesaid grievances.

The learned counsel for the respondent-State Shri Alok Ranajn, AC to AAG-5 has got no objection.

Accordingly, the present writ petition stands disposed off with liberty to the petitioner to file appropriate representation before the respondent no. 2 and in case such a representation is

It is needless to state that the writ petition has not been filed by the Association but by the petitioner, namely, Tarkeshwar Singh, hence it is the petitioner himself who shall be at liberty to file the aforesaid representation and none else.
