JUSTICE SHIVAJI PANDEY ORAL ORDER 20-07-2016 Learned counsel for the University has stated in paragraph 4 of the show cause that petitioner is required to file an application and only then 54% of arrears of pension will be released.
It does not understand to reason as ot why the State Government has asked again the petitioner to file an affidavit with regard to fixation of pay, when already its auditor has checked and verified.
The University is directed to release 54% pension without unnecessary delay preferably within a period
Patna High Court MJC No.1265 of 2015 (8) dt.20-07-2016 of four weeks from today. If any genuine objection is raised by the University or the State Government, the same will be taken into consideration in accordance with law. In case of shortage of fund the State Government must ensure that the funds must be released to the University for payment of dues to the petitioner.
With the aforesaid observation this application is disposed of.
